Russia's Constitutional Court has agreed with the arguments of Pepeliaev Group’s lawyers and has protected utility companies in bankruptcy cases
Based on the appeal of T Plus PJSC, which was prepared by Pepeliaev Group’s specialists, the Russian Constitutional Court (the “Constitutional Court”) has declared unconstitutional the provisions of article 134(1)(2) of the Federal Law “On insolvency (bankruptcy)” to the extent that they do not provide a proper degree of certainty when establishing the circumstances entailing payment to a supplier for energy resources preferentially out of turn ahead of any other claims of creditors relating to current payments.
In 2022, Pepeliaev Group is celebrating its 20th anniversary. The firm has strengthened considerably over the years: the number of lawyers and other employees has grown from around twenty to 300, while the number of clients has increased from 50 to 2,000 and there are now seven offices.
